Turnkey Edge Dynamics – Terms of Service

By registering for an account, accessing, or using the Yield Matrix Pro dashboard ("the Service"), you (the "Subscriber", "Agent", or "Agency") agree to be bound by these Terms and Conditions. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.2. The Service, Third-Party Data, and Availability
2.1 Service Provision: The Service provides analytics and data visualization for real estate professionals.
2.2 Third-Party API Reliance: The Service heavily relies on property data sourced via Application Programming Interfaces (APIs) from third parties, specifically Domain Developers. You acknowledge that Turnkey Edge Dynamics does not control this third-party data. We make no warranties regarding the accuracy, completeness, or continuous availability of Domain Developers' data. If the third-party provider suspends or alters their API, we reserve the right to modify or suspend our Service accordingly without liability.
2.3 Service Level and Maintenance: The Service is provided on an "as is" and "as available" basis. While we endeavor to maintain high uptime, we do not provide a guaranteed Service Level Agreement (SLA). We reserve the right to schedule maintenance windows and are not liable for business interruption or compensation claims arising from temporary platform outages.3. Subscription, Free Trial, and Payment
3.1 Free Trial: New Subscribers are eligible for a seven (7) day free trial. During this period, you will have full access to the Service without charge.
3.2 Subscription Fees: Following the expiration of the free trial, continued access to the Service requires a paid subscription at the rate of $199.00 AUD (inclusive of GST) per month, per company/agency.
3.3 Billing: Subscription fees are billed in advance on a monthly billing cycle. Fees are non-refundable except as required by law.
3.4 Cancellation: You may cancel your subscription at any time prior to your next billing cycle to avoid further charges.4. User Obligations & Indemnification
You agree to:
a) Use the Service strictly for lawful business purposes.
b) Not reverse engineer, decompile, or copy the Service’s software or algorithms.
c) Maintain the confidentiality of your login credentials.
d) Not scrape, data-mine, or systematically extract data from our Service for use outside your agency's internal operations.
e) Indemnification: Fully indemnify and hold harmless Turnkey Edge Dynamics against any legal claims, penalties, or damages arising from your misuse of the Service, violation of these Terms, or breach of third-party API licensing rules.5. Privacy and Data Governance
5.1 Compliance: Both parties must comply with the Privacy Act 1988 (Cth).
5.2 Data Roles: Where you input client Personally Identifiable Information (PII) into the Service, you act strictly as the "Data Controller" and warrant you have obtained all necessary consents. Turnkey Edge Dynamics acts strictly as the "Data Processor."
5.3 Data Lifecycle: Upon subscription termination, we will retain your account data for a maximum of thirty (30) days, after which all inputted PII and account metrics will be permanently and securely destroyed.6. Intellectual Property
6.1 Our IP: All intellectual property rights in the Service, including the dashboard design, analytics algorithms, and software, are owned by Turnkey Edge Dynamics.
6.2 Your License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service in accordance with these Terms.7. Limitation of Liability and Warranties
7.1 Australian Consumer Law (ACL): Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Competition and Consumer Act 2010 (Cth) that cannot be lawfully excluded.
7.2 Limitation: To the maximum extent permitted by law, Turnkey Edge Dynamic’s liability for any breach of a non-excludable condition or warranty is limited, at our option, to the re-supply of the services or the cost of having the services supplied again.
7.3 Exclusion for Consequential Loss: Under no circumstances shall we be liable for any indirect, incidental, or consequential loss, including loss of profits, lost data, or business interruption arising out of your use of the Service.8. Termination
We reserve the right to suspend or terminate your access to the Service immediately, without notice, if you breach any material term of these Terms.9. Dispute Resolution
Prior to commencing any formal legal proceedings, both parties agree to engage in mandatory, good-faith mediation or negotiation for a period of no less than thirty (30) days to attempt to resolve any dispute arising from these Terms or the use of the Service.10. Amendments to Terms
We reserve the right to amend these Terms at any time. We will provide at least thirty (30) days written notice (via email or dashboard notification) prior to any material changes taking effect. Continued use of the Service after this period constitutes acceptance. If you reject the new terms, you retain the right to terminate your subscription without penalty prior to the changes taking effect.11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of that State.

Turnkey Edge Dynamics acts strictly as a Data Processor and will only handle this data to deliver the Service as instructed by the Subscriber.3. How We Collect Information
